ANÁLISE DA EVOLUÇÃO LEGAL DA PROTEÇÃO DOS RECURSOS HÍDRICOS NO ESTADO DO MARANHÃO

Por muitas décadas, os recursos hídricos foram considerados
um recurso natural ilimitado e abundante, mas com o
passar do tempo, percebeu-se que as águas são recursos
naturais inseridos no meio ambiente com características de
limitações quantitativas e qualitativas. A utilização dos
recursos hídricos é orientada pela Política Nacional de Recursos
Hídricos (PNRH). Este estudo objetivou analisar a
evolução da proteção dos recursos hídricos no estado do
Maranhão, após a promulgação da PNRH. O desenvolvimento
se deu a partir de uma análise bibliográfica e documental
junto a Secretaria Estadual do Meio Ambiente. Foi
possível verificar uma dificuldade em promulgar e implementar
a PNRH no Maranhão, pois apenas em 2004 foi
publicada a Lei nº 8.149/04, que institui a Política Estadual
de Recursos Hídricos (PERH) e somente em 2012 foi regulamentada
a criação dos dois Comitês existentes no estado
do Maranhão. Atualmente o estado do Maranhão possui
apenas dois Comitês de Bacias Hidrográficas (CBH), a do
Munin e Mearim. Desta forma, ficou nítido que o estado do
Maranhão teve dificuldades e/ou desinteresse de implantar
sua PERH, no entanto, se faz necessário deslumbrar com
mais rapidez e eficiência a criação dos demais comitês para
proporcionar uma gestão participativa e descentralizada no
estado.
